What is Prop 65?

California’s Proposition 65 or the Safe Drinking Water and Toxic Enforcement Act Enacted In 1986

Generally, the Act requires businesses to provide clear and reasonable warnings to Californian consumers about exposures to certain chemicals that the State of California has determined cause cancer, birth defects or other reproductive harm.

Companies must provide clear & reasonable notice to consumers if their products that are sold into the State of California contain certain chemicals, as listed at https://oehha.ca.gov/proposition-65/proposition-65-list which are known to cause cancer, birth defects or other reproductive harm.

Who Is Affected:

Any customer that sells a product to a person or business within the State of California that contains any of the listed Chemicals may be subject to the warning requirement. The seller of the product must provide clear & reasonable warnings to the consumer of exposure to listed Chemicals that cause cancer, birth defects, or other reproductive harm in the products he, she or they purchased. The warnings must be given as displayed below. They cannot be altered.
